When the Commission receives a petition or communication claiming that it violates one of the rights protected by this convention, how can we guarantee corporate accountability in the context of growing corporate power and deteriorating conditions for human rights violations? This is a central issue that States will discuss at the 5th meeting of the Intergovernmental Working Group on Transnational Groups and Other Economic Enterprises currently being held in Geneva. This document provides an overview of the main issues and concerns concerning the interface between human rights, trade and development. But TNNs are able to evade national jurisdiction because of their transnational nature and the unprecedented economic, financial and political power they have, their economic and legal flexibility, and the complex structures they use to conduct their operations. That is why impunity generally prevails, especially when the communities and peoples concerned are in the global South. » [18] 2.
